Pure Path Northwest products are classified as dietary supplements under the Dietary Supplement Health and Education Act of 1994 (DSHEA), 21 U.S.C. §321(ff). TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR AMOUNTS PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Pure Path Northwest LLC from any claims, damages, or expenses arising from your use of this Service, violation of these Terms, or any health claim you make based on information from this Service.
YOU AND PURE PATH NORTHWEST LLC AGREE THAT ANY DISPUTE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES, PURSUANT TO THE FEDERAL ARBITRATION ACT (9 U.S.C. §§1-16). YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY CLASS PROCEEDING.
Before arbitration, parties must attempt informal resolution for 60 days. Arbitration hearings shall occur in Kootenai County, Idaho. You may opt out within 30 days of first use by written notice to dannyppnw@gmail.com.
These Terms are governed by the laws of the State of Idaho. Exclusive jurisdiction lies in the courts of Kootenai County, Idaho.
If any provision is found unenforceable, the remaining provisions continue in full force and effect.
